Intellectual Property Policy

Effective Date: September 11, 2026

This Intellectual Property Policy (“Policy”) explains how Idea Max (“Idea Max,” “we,” “us,” or “our”) handles copyrights, trademarks, licensed artwork, customer-submitted content, and other intellectual property matters in connection with our website, DTF transfer products, gang sheets, print-on-demand services, custom printing services, and related products and services (collectively, the “Services”).

By using our Services, submitting artwork to us, or placing an order, you agree to this Policy and our Terms of Service.

We respect intellectual property rights and expect our customers and users to do the same.

1. Customer-Submitted Content

Customers may submit or upload photographs, artwork, graphics, logos, text, trademarks, designs, images, files, and other materials for printing or order fulfillment (“Customer Content”).

You retain all ownership rights that you have in your Customer Content.

By submitting Customer Content to Idea Max, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, reproduce, resize, crop, arrange, convert, process, transmit, and otherwise handle the Customer Content only as reasonably necessary to:

  • Prepare and produce your order;
  • Create print files, transfer layouts, or gang sheets;
  • Generate product previews or proofs;
  • Perform quality control;
  • Manufacture, package, and ship your order;
  • Communicate with you regarding your order;
  • Provide customer service and resolve disputes relating to your order; and
  • Maintain reasonable business and transaction records.

This license lasts only for as long as reasonably necessary to provide the Services, fulfill legal or recordkeeping requirements, and resolve disputes.

Submitting Customer Content does not transfer ownership of that content to Idea Max.

2. Marketing Use of Customer Content

Idea Max will not obtain ownership of Customer Content merely because it was submitted for printing.

We will not use identifiable Customer Content as a public advertising example, portfolio item, social media post, promotional sample, or marketing material unless:

  • You have separately authorized such use;
  • The content has been independently licensed to Idea Max for that purpose; or
  • We otherwise have a lawful right to use the content.

Permission to manufacture an order does not automatically constitute permission to use Customer Content for public marketing.

3. Customer Representations and Responsibilities

By submitting Customer Content, you represent and warrant that:

  • You own the content or have all permissions, licenses, and rights necessary for Idea Max to reproduce and print it;
  • The requested use does not infringe any copyright, trademark, trade dress, patent, privacy right, publicity right, or other right of a third party;
  • You have obtained any necessary permission to use names, photographs, likenesses, logos, characters, brands, or other protected material appearing in the content;
  • The content and requested use comply with applicable laws; and
  • The content does not contain malicious software, viruses, or intentionally harmful code.

You are responsible for determining whether you have sufficient rights to submit and reproduce Customer Content.

Idea Max's acceptance, processing, or printing of an order does not constitute legal approval or confirmation that the Customer Content is non-infringing.

4. Third-Party Licensed Artwork

Certain designs, graphics, fonts, illustrations, patterns, or other artwork offered on Idea Max products may be obtained by Idea Max pursuant to commercial licenses from third-party designers, marketplaces, licensors, or other rights holders (“Licensed Artwork”).

Idea Max does not claim ownership of third-party Licensed Artwork except to the extent that Idea Max separately owns rights in original elements created by Idea Max.

Copyright and other intellectual property rights in Licensed Artwork remain with the applicable rights holders.

Our commercial licenses may allow us to incorporate Licensed Artwork into physical products, including certain printed DTF transfers, transfer sets, gang sheets, apparel, accessories, promotional products, or other physical products.

The availability of a product through Idea Max does not mean that the underlying artwork is owned exclusively by Idea Max.

5. Pre-Designed DTF Transfers and Gang Sheets

Idea Max may offer pre-designed physical products, including:

  • Individual DTF transfers;
  • Sets of DTF transfers;
  • Ready-to-press transfers;
  • Pre-arranged gang sheets; and
  • Other printed transfer products.

Unless expressly stated otherwise, the purchase of such a product is the purchase of a physical printed transfer product only.

The purchase does not include:

  • A PNG file;
  • An SVG file;
  • An EPS, AI, PSD, or other source file;
  • A downloadable digital copy of the artwork;
  • Ownership of the underlying artwork;
  • Copyright ownership;
  • A sublicense to redistribute the underlying artwork; or
  • Permission to create additional copies of the artwork or transfer independently.

No digital artwork file is included unless a listing expressly identifies the product as a digital product.

6. Permitted Use of Physical Transfers

A customer may use a purchased physical transfer for its intended physical application, subject to the applicable product listing, this Policy, and any product-specific restrictions.

Where Idea Max expressly allows commercial end-product use, that permission applies to the physical transfer unit purchased from Idea Max and its intended application to a physical end product.

Unless expressly authorized, purchasing a transfer does not permit you to:

  • Scan the transfer;
  • Photograph or extract the artwork for reproduction purposes;
  • Trace or digitally recreate the artwork;
  • Create your own transfer files from the artwork;
  • Manufacture additional transfers from the artwork;
  • Distribute the artwork electronically;
  • Upload the artwork to another print provider for reproduction;
  • Sell or share the artwork as a digital file; or
  • Represent that you own the copyright in third-party Licensed Artwork.

7. No Digital Redistribution

Customers may not reproduce, extract, distribute, sublicense, sell, share, upload, or otherwise provide digital versions of artwork displayed on or incorporated into Idea Max physical transfer products unless the customer independently owns or has independently obtained rights to that artwork.

Product images displayed on our website are provided for shopping, preview, and informational purposes.

The ability to view an image on our website does not grant permission to download, copy, extract, reproduce, distribute, or commercially exploit the underlying artwork.

8. Idea Max Original Content

The Idea Max name, trademarks, logos, original photographs, original product photography, website copy, product descriptions, original graphics, layouts, software, website components, and other content created by Idea Max (“Idea Max Content”) are owned by or licensed to Idea Max and may be protected by copyright, trademark, and other applicable laws.

You may not reproduce, republish, distribute, modify, scrape, or commercially use Idea Max Content without authorization, except as permitted by applicable law.

For clarity, this section does not claim Idea Max ownership over third-party Licensed Artwork merely because that artwork appears on an Idea Max product or website page.

9. Custom Printing and Intellectual Property Compliance

Idea Max provides DTF printing, gang sheet printing, POD, custom printing, and related manufacturing services.

For customer-submitted orders, Idea Max generally acts as a production service provider and relies on the customer's representations regarding intellectual property rights.

Idea Max does not provide legal advice concerning whether particular artwork may lawfully be reproduced.

We may, but are not required to, review an order when we become aware of a possible intellectual property concern.

Idea Max reserves the right to:

  • Refuse an order;
  • Pause production;
  • Request evidence of ownership or authorization;
  • Cancel an order;
  • Remove submitted content from our systems when appropriate; or
  • Restrict or terminate access to our Services.

We may take these actions when we reasonably believe that Customer Content or a requested use may violate applicable law, third-party rights, this Policy, or our Terms of Service.

10. Trademarks, Brands, Characters, and Other Protected Material

The fact that a logo, character, photograph, phrase, brand name, celebrity image, sports team mark, entertainment property, or other protected material is available online does not necessarily mean that it is free to reproduce commercially.

Customers submitting such material are responsible for obtaining all rights and permissions required for their requested use.

Idea Max may request documentation demonstrating authorization.

Failure to provide satisfactory documentation may result in refusal or cancellation of the order.

11. Name, Image, and Likeness

If Customer Content contains the name, image, likeness, voice, or other identifying characteristics of another person, you represent that you have obtained all permissions required for the requested use.

For content involving a minor, you are responsible for obtaining any legally required authorization from the minor's parent or legal guardian.

12. Production and Fulfillment Partners

Idea Max may use contractors, printers, production facilities, software providers, fulfillment providers, logistics providers, or other third parties (“Service Providers”) when reasonably necessary to provide the Services.

When necessary to fulfill an order, Idea Max may provide Customer Content to such Service Providers solely for purposes related to production, quality control, fulfillment, shipment, technical processing, or customer service.

Idea Max does not grant Service Providers ownership of Customer Content merely by transmitting content for fulfillment purposes.

13. Intellectual Property Complaints

Idea Max respects legitimate intellectual property rights.

If you believe content or a product offered through our Services infringes your copyright or trademark, please contact:

Email: info@idea-max.com

Please provide sufficient information for us to investigate the claim, including:

  • Your full name and contact information;
  • Identification of the copyrighted work, trademark, or other right you claim is being infringed;
  • Identification of the material or product at issue, preferably including the applicable URL;
  • An explanation of the basis of your claim;
  • Documentation or other information showing your ownership or authority to act for the rights holder; and
  • A statement that the information provided is accurate and submitted in good faith.

We may request additional information before taking action.

14. DMCA Copyright Notices

Copyright owners or their authorized agents may submit notices of claimed copyright infringement consistent with the Digital Millennium Copyright Act (“DMCA”), where applicable.

A DMCA notice should contain the information required under 17 U.S.C. § 512, including:

  • A physical or electronic signature of an authorized person;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the allegedly infringing material and information reasonably sufficient to locate it;
  • Contact information for the complaining party;
  • A good-faith statement regarding the allegedly unauthorized use; and
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that the complaining party is authorized to act on behalf of the copyright owner.

Notices may be sent to the copyright contact identified by Idea Max.

Email: info@idea-max.com

Where applicable, Idea Max may remove or disable access to disputed material while a claim is reviewed.

15. Counter-Notifications

Where the DMCA applies and material has been removed or disabled in response to a copyright notice, the affected party may be eligible to submit a counter-notification meeting the requirements of 17 U.S.C. § 512.

A valid counter-notification may require, among other things:

  • Identification of the removed material;
  • A statement under penalty of perjury that the removal resulted from mistake or misidentification;
  • The submitter's name, address, and telephone number;
  • Required consent to jurisdiction; and
  • A physical or electronic signature.

Idea Max may provide a qualifying counter-notification to the original complaining party as required or permitted by applicable law.

16. Repeat Infringers

Idea Max may suspend or terminate accounts or refuse service to users who repeatedly infringe intellectual property rights or repeatedly submit unauthorized content.

We may also take appropriate action in response to a single serious infringement.

17. Indemnification for Customer-Submitted Content

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Idea Max and its officers, employees, affiliates, contractors, and Service Providers from third-party claims, losses, liabilities, damages, costs, and reasonable attorneys' fees arising from:

  • Customer Content submitted by you;
  • Your lack of authorization to reproduce submitted material;
  • Your violation of third-party intellectual property rights;
  • Your breach of your representations under this Policy; or
  • Your unlawful use of the Services.

This section does not limit liability that cannot legally be limited or excluded.

18. Changes to This Policy

We may update this Policy from time to time to reflect changes to our Services, business practices, licensing arrangements, or applicable law.

When we make changes, we will update the Effective Date displayed at the top of this Policy.
